This agreement sets out the terms and conditions ('Terms and Conditions') applicable to
members of the service operated by ChristianLance.com. Applicants (referred to as
'members') must agree to the following Terms and Conditions. In the event a member
breaches or otherwise fails to comply with any provision of these Terms and Conditions, ChristianLance.com may terminate the
participation of such member in the service and/or may withhold any payments
relating to participation in the service due to such member from ChristianLance.com.
ELIGIBILITY REQUIREMENTS
ChristianLance.com shall have absolute discretion as to whether or not it accepts a particular
applicant or site for participation in the service. Our services are available only to individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to minors. Children are not eligible to use our services and we ask that minors (under the age of 18) do not submit any personal information to us. If you do not qualify, please do not use our services. Further, our services are not available to temporarily or indefinitely suspended ChristianLance.com members.
REMOVAL FROM NETWORK
ChristianLance.com reserves the right to terminate the participation of any member or site
without reason but expressly including any member site that ChristianLance.com judges to be in
violation of the Terms and Conditions.
Members in violation of ChristianLance.com's Terms and Conditions will be immediately deactivated.
ChristianLance.com may deactivate members with no prior notification, though every effort will be
made to notify the deactivated member via the email address provided by the member.
Members found in violation of the Terms and Conditions will not receive any credit or
payment from ChristianLance.com. Members that are terminated by ChristianLance.com on any basis other than
violation of these Terms and Conditions will be entitled to receive any payment due from
ChristianLance.com.
PROHIBITED PROJECTS
ChristianLance.com is a Christian site. You may not post projects or messages that contain inapproriate materials. ChristianLance.com reserves the right to delete objectionable projects as well as terminate users who violate this provision. Inappropritate materials inlucde but not limited to: pornography, obscenity, foul language, gambling, pirated warez, illegal items, occult, cult, etc.
FEEDBACK SYSTEM
You may not take any actions that may undermine the integrity of the feedback system:
1) Export: You acknowledge that your feedback consists of comments left by other users and a composite feedback number compiled by ChristianLance.com, and that the composite number without the comments does not convey your full user profile. Because feedback ratings are not designed for any purpose other than for facilitating services/trading between ChristianLance.com users, you agree that you shall not market or export your ChristianLance.com feedback rating in any venue other than ChristianLance.com.
2) Import: We do not provide the technical ability to allow you to import feedback from other websites to ChristianLance.com because a composite number, without the corresponding feedback does not reflect your true online reputation within our community.
REFERRAL COMMISSIONS
The referral commission paid out will be the one listed on the Referrals page (http://www.christianlance.com/html/referral.shtml). If the commission rate is changed, it will only affect referrals made after the new commission was announced. You may not refer yourself, nor sign up for multiple accounts to collect referral fees. You may also not partner with any other ChristianLance.com user to share/transfer the commission made from your own accounts, or else both parties will be terminated from ChristianLance.com without payment.
COMMISSION FEES ON PROJECTS
Christianlance.com does not charge signup fees, membership fees, and no monthly fee. However, there is a minimal commission on each completed project. The commission is 3% of the bid amount or minimum of $2.00, whichever is greater. Both project creator (Webmaster) and winning bidder (Programmer) will be assessed the 3% fee.
For Example: If you chose a programmer who made a bid for $70 on your project, 3% (or $2.10) of that amount will be charged to your ChristianLance account. The programmer that you have chosen will also pay 3%.
To get you started, we give you FREE $2.00 to cover the commission on your first project. The FREE $2.00 Sign-Up bonus is non-refundable and is valid only toward project fees.
PAYMENTS
ChristianLance.com's built-in online payment system is a convenience provided to its Users and is optional.
1) DEPOSITS - ChristianLance.com accepts deposits by Credit Cards (through secure www.2CheckOut.com), PayPal, or Check payment by mail.
2) WITHDRAWAL - ChristianLance.com will print and mail checks upon member's request provided that member's account balance is equal to or greater than $20. This also applies to payments made through the PayPal service. All amounts will be made in US funds. Also available are fund transfer by Bank Wire and C2It.com.
As previously stated, any member site that ChristianLance.com removes from the service
due to violation of the Terms and Conditions will receive no credit or payment.
3) TRANSFER - A Webmaster (Project Creator) may pay a Programmer by transferring funds from his/her account to the programmer's account. The minimum amount that can be transferred is $10. This service is free!
5) FEES - Some fees may apply for deposits and withdrawals. Please visit Fees Shedule for exact information.
COPYRIGHTS
No copyright material can be posted on ChristianLance.com. This includes scripts which are sold by the author. Only posting sections of these scripts, as examples, will be permitted. A "section" being no more than 10% of the script's contents. This is meant to protect the author's rights.
E-MAIL ADDRESSES
Members agree not to post their e-mail address on the site, except in the "e-mail" field of the signup form, or when asked by ChristianLance.com at any other time. There should be no need to give anyone your e-mail address. It is automatically provided if you choose a programmer (or you are the programmer chosen for) a project, and before that time you can use the message board to communicate. This does not only apply to e-mail addresses, but to all methods of communication, including phone, ICQ, AIM, MSN Messenger, etc... See "Avoiding Commissions" below for the reason.
PROVIDING CONTACT INFORMATION
You are prohibited from making direct contact with another member, unless it's for a project you (a programmer) have been picked for, or you (a webmaster) have picked a programmer for. This includes giving out your e-mail address, ICQ number, phone number, or any other method of contact outside of this site. ChristianLance.com provides you with message boards, which should be sufficient for pre-project planning. The only exception to this is on "Featured" projects. If a project has the "Featured" graphic on it, that means the webmaster has paid a flat fee in advance, and you ARE allowed to provide contact information in the message board. Note that the ChristianLance.com system does not distinguish between featured and non-featured message board posts, so you will still get a warning when submitting an e-mail address, even if the project is featured.
AVOIDING COMMISSIONS
You are strictly prohibited from attempting to negotiate the fee for a project with another member directly (outside of ChristianLance.com) after that project has been created/opened/posted on ChristianLance.com and before that project has been closed (basically, during an ongoing project). We believe our commissions are very fair and justified for the service we provide, therefore we will absolutely not tolerate any of this kind of activity on ChristianLance.com.
ADVERTISING
You are prohibited from advertising your website on ChristianLance.com. Any URL posted in a bid, project description, or the message board, must relate to a project on ChristianLance.com. An example of a permissible URL: your resumé page.

CHRISTIANLANCE.COM IS ONLY A VENUE
ChristianLance.com functions as a venue to connect webmasters and programmers in a virtual marketplace. As a neutral facilitator, ChristianLance.com is not directly involved in the actual transactions between users of the Site. As a result, ChristianLance.com has no control over the truth, accuracy, quality, legality, or safety of postings made by users. Because verifying the identity of a user on the Internet is difficult, ChristianLance.com cannot and does not confirm the identity of users. ChristianLance.com also does not confirm nor verify the qualifications, background, or abilities of users. Therefore, We recommend that You be careful and exercise common sense and good judgment when dealing with any member on the Site. You are encouraged to review our Project Guidelines before taking part in a project. If you are unsatisifed with another member, the most ChristianLance.com can do is refund the project commission you have been charged by us. We cannot refund the money you have sent to someone, we are not responsible for your transactions.
INDEMNITY
You agree to indemnify and hold us and our subsidiaries, affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to your posted projects or bidding on a project, or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.
NO AGENCY
You and ChristianLance.com are independent contractors, and no agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.
NO WARRANTY
WE AND OUR SUPPLIERS PROVIDE OUR WEB SITE AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. WE AND OUR SUPPLIERS SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
ARBITRATION
Any controversy or claim arising out of or relating to this Agreement or our services shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in Alabama, and judgment on the arbitration award may be entered into any court having jurisdiction thereof. Either you or ChristianLance.com may seek any interim or preliminary relief from a court of competent jurisdiction in Alabama necessary to protect the rights or property of you or ChristianLance.com pending the completion of arbitration.
GENERAL
This Agreement shall be governed in all respects by the laws of the State of Alabama as such laws are applied to agreements entered into and to be performed entirely within Alabama between Alabama residents. We do not guarantee continuous, uninterrupted or secure access to our services, and operation of our site may be interfered with by numerous factors outside of our control. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced. Headings are for reference purposes only and in no way define, limit, construe or describe the scope or extent of such section. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof.
AMENDMENTS
ChristianLance.com may amend this Agreement at any time by posting the amended terms on its Web site. All amended terms are automatically effective 15 days after they are initially posted. Continued participation and use of ChristianLance.com services means you assent to such changes. This agreement was last revised on March 02, 2002.
It is the member's responsibility to check these Terms and Conditions from time to time for such
changes.
ASSIGNMENT, SUBCONTRACTING, TRANSFER
ChristianLance.com may assign, subcontract, or transfer this Agreement and/or its Services anytime at its sole discretion.
In the event ChristianLance.com offers any additional or replacement services then this
agreement shall apply to such services in the absence of any new agreement specific to
such services which is entered into between the parties.
OWNERSHIP
Members agree that all information contained on a website operated by ChristianLance.com, and all information compiled by ChristianLance.com through operation of the affiliate
program, is the proprietary information of ChristianLance.com. Personal information provided by
members to ChristianLance.com will be kept confidential and will not be distributed to any third
